Terms of Service

This website is operated by Wild Rose. Throughout the site, the terms "we," "us," and "our" refer to Wild Rose, operated by AMScale LLC.

We provide this website, including all information, tools, and services available from this site, to you conditioned upon your acceptance of the following terms and conditions ("Terms," "Terms of Use").

By visiting our website and/or purchasing an item, you agree to these Terms and Conditions. These Terms and Conditions apply to all users of the website.

Please read these Terms and Conditions carefully before using the website. If you do not agree to the Terms, you may not use our website or services.

1. Terms and Conditions for the Online Shop

By using this website, you confirm that you are of legal age in your country of residence, or that you have given us permission to allow minor dependents to use the site.

You may not use our website or products for unlawful purposes. It is prohibited to transmit malicious code or impair the functionality of the service. Any violation will result in termination of your access to our services.

2. General Terms and Conditions

We reserve the right to refuse orders for legitimate reasons (for example, technical errors or suspected misuse).

Data transmissions over the internet (excluding payment information) may take place unencrypted. Payment information is always transmitted securely via encrypted networks.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the service or website without our express permission.

3. Accuracy and Timeliness of Information

We are not responsible if information on this site is incomplete, outdated, or inaccurate. All content is provided for general informational purposes only and does not constitute professional advice.

We reserve the right to modify content at any time.

4. Changes to Services and Prices

Product prices are subject to change at any time. We may modify or discontinue services or parts of the website without prior notice for legitimate reasons.

All prices displayed on our website are inclusive of applicable VAT for UK and EU customers, unless stated otherwise. Customs duties or import taxes may apply for deliveries outside the UK and EU and are the responsibility of the customer.

5. Formation of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue.

By clicking the "Buy" or "Checkout" button, you submit a binding offer to purchase the selected products.

An automatically generated order confirmation does not constitute acceptance of the contract. The purchase contract is concluded only when we confirm shipment of the goods.

6. Right of Withdrawal (Cooling-Off Period)

As a consumer resident in the United Kingdom or the European Union, you have the right to withdraw from this contract within 14 days without giving any reason, in accordance with the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the EU Consumer Rights Directive (2011/83/EU).

The withdrawal period expires 14 days after the day on which you, or a third party indicated by you, acquires physical possession of the goods (or the last item, in the case of a multi-item order).

To exercise your right of withdrawal, you must inform us of your decision via a clear statement by:

Effects of withdrawal: if you withdraw from this contract, we will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the day on which we are informed of your decision. Reimbursement will be made using the same means of payment as the initial transaction.

We may withhold reimbursement until we have received the goods back, or until you have supplied proof of having sent the goods back, whichever is the earliest.

You must return the goods to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal. You will bear the direct cost of returning the goods unless we have explicitly agreed otherwise. Full return instructions are set out in our Return & Refund Policy.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

7. Warranty and Consumer Rights

Products are covered by your statutory rights under:

  • United Kingdom: the Consumer Rights Act 2015, which entitles you to goods that are of satisfactory quality, fit for purpose, and as described
  • European Union: the Consumer Sales Directive (2019/771/EU) and national implementations thereof, which provide a minimum two-year legal guarantee against defects existing at the time of delivery

Nothing in these Terms affects your statutory rights as a consumer under applicable mandatory law.

8. Products and Services

Some products may be available exclusively online and in limited quantities.

We strive to display product images and colours as accurately as possible. However, variations may occur due to different screen or display settings.

We reserve the right to restrict sales to certain regions or persons where legitimate reasons exist. Products may be discontinued or modified at any time.

Shipping information: all products are shipped directly from our logistics centre in Asia to the end consumer. Delivery times typically range between 7 and 14 working days within the United Kingdom and the European Union. Customs duties or import taxes generally do not apply for shipments to the UK and EU under current trade arrangements, but may apply for shipments outside these territories and are the responsibility of the customer.

9. Billing and Account Information

We reserve the right to review, modify, or reject orders if incorrect or suspicious information is detected.

You agree to provide accurate, current, and complete account and purchase information and to update it if changes occur.

10. Optional Third-Party Tools

We may provide access to third-party tools over which we have no control. Use of such tools is entirely at your own risk.

11. Links to Third-Party Providers

Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of third-party providers. Any transactions with third-party providers take place exclusively between you and the respective provider.

12. User Content and Comments

If you submit content, suggestions, or comments, you grant us a non-exclusive, royalty-free, worldwide licence to use them for business purposes.

You must not submit content that violates the rights of third parties or applicable laws. You are solely responsible for any content you provide.

13. Personal Data

Personal data is processed in accordance with our Privacy Policy and in compliance with the UK General Data Protection Regulation (UK GDPR), the EU General Data Protection Regulation (EU GDPR), the UK Data Protection Act 2018, and the EU e-Privacy Directive.

14. Errors, Inaccuracies and Omissions

Information on the website may contain errors or inaccuracies. We reserve the right to correct such issues at any time without prior notice.

15. Prohibited Uses

The website may not be used for unlawful, misleading, harmful, or abusive purposes. Violations may result in immediate suspension or termination of access.

16. Limitation of Liability

We are liable only to the extent permitted by applicable law. Liability for minor negligence is limited to breaches of essential contractual obligations. Nothing in these Terms excludes or limits our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law. Your statutory consumer rights remain unaffected.

17. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your unlawful use of the website or violation of these Terms.

18. Severability Clause

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Termination

These Terms remain effective until terminated by either party. We may immediately terminate access in the event of violations.

20. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and Wales, without prejudice to the mandatory consumer protection laws applicable in your country of residence.

Disputes arising from or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. Consumers resident in the European Union or the United Kingdom may also bring proceedings before the courts of their country of residence, in accordance with applicable consumer protection law.

21. Online Dispute Resolution (EU consumers)

The European Commission provides a platform for online dispute resolution, available at ec.europa.eu/consumers/odr. You have the right to use this platform to resolve disputes arising from online purchases.

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board, unless otherwise required by mandatory law.

22. Returns and Refunds

Information regarding returns and refunds, including how to exercise your right of withdrawal (see Section 6), can be found in our Return & Refund Policy.
